1. Definitions
- “SWAI” refers to the company providing the software.
- “Software” refers to the SWAI AI-powered marketing and advertising platform, including any updates or modifications.
- “User” refers to the individual or entity accessing or using the Software.
- “User Data” refers to any data related to the User’s business, marketing activities, or clients that is processed by the Software.
2. License Grant
SWAI grants the User a non-exclusive, non-transferable, revocable license to access and use the Software solely for the purpose of creating, managing, and optimizing marketing and advertising campaigns.
3. User Responsibilities
- The User is responsible for the accuracy, legality, and completeness of all User Data input into the Software.
- The User must review and ensure the appropriateness of all marketing materials and campaigns generated by the Software before distribution.
- The User is ultimately responsible for the content and outcomes of all marketing campaigns managed through the Software.
- The User shall not use the Software for any illegal or unauthorized purposes.
- The User shall not attempt to reverse engineer, decompile, or disassemble the Software.
4. Data Protection and Security
- SWAI is committed to protecting the security and privacy of User Data.
- User Data is encrypted and stored on secure servers.
- SWAI complies with all relevant data protection regulations, including the General Data Protection Regulation (GDPR).
- The User retains full ownership of all User Data.
5. Fees and Payment
- The User agrees to pay the fees for the Software as set out on the SWAI website or within any custom terms provided.
- Fees are payable in advance on a monthly or annual basis.
- SWAI reserves the right to change the fees at any time, with prior notice to the User.
6. Cancellation
- The User may cancel their subscription to the Software at any time by submitting their consent via within the software.
- Upon cancellation, the User will have access to their account and data for the remainder of the current billing cycle.
- The User may choose to either pause their account or permanently delete their data upon cancellation.
7. Limitation of Liability
- SWAI shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Software.
- SWAI’s total liability to the User shall not exceed the fees paid by the User for the Software in the 12 months preceding the claim.
8. Governing Law
This EULA shall be governed by and construed in accordance with the laws of England and Wales.
9. Entire Agreement
This EULA constitutes the entire agreement between SWAI and the User and supersedes all prior or contemporaneous communications and proposals, whether oral or written, with respect to the Software.
